REFUND AND CANCELLATION POLICY

By acquiring and using the Services, Plans, Digital Services, Mentorships, Educational Programs, or Subscriptions (collectively the “Service[s]” or “service[s]”) offered by Breathing with the Markets LLC (“BWTM”), you agree to the terms below, along with BWTM’s Privacy PolicyTerms of Use, and Disclaimers.

Standard Return Policy

Once you acquire the Services through any of our official platforms, or other platforms necessary to provide the Services described herein, BWTM will not issue refunds or exchanges. In addition, please note:

  • No Refunds on Services: All Services provided by BWTM are strictly non-refundable. By agreeing to pay for any Service offered by BWTM, users accept that no refunds will be issued under any circumstances once a Service is paid for and rendered. This policy reflects the commitment and resources that BWTM allocates to initiate and complete the services requested by our users.


In the event of extenuating circumstances, users are encouraged to contact our customer service to discuss potential accommodations or solutions. However, these cases will be addressed at BWTM’s discretion and do not guarantee a deviation from our no-refund policy.

  • Subscription Services Cancellation (If applicable): Users who have opted for our subscription-based services can discontinue their subscriptions. To cancel a subscription, the user must notify us before the next billing period commences. It is important to note that while users can terminate their subscription before the next billing cycle starts, no refunds will be issued for any portion of the current billing period. This applies regardless of the level of service utilization during that period. For more details on cancellation procedures for subscription-based services, associated fees, or any other inquiries, please refer to the detailed terms and conditions section below.
  • Mentorships and Custom Services: BWTM may offer services that can be tailored to meet our users’ specific requirements. Due to the personalized nature of these services, all sales of custom Services and Mentorships are final and not eligible for refunds once the Mentorship has been purchased.
  • Non-Transferability of Services: Services purchased from BWTM are non-transferable. Once a Service has been purchased, the rights and obligations under this agreement are strictly non-transferable. The user shall not assign, transfer, or delegate any of their rights, responsibilities, or obligations under the agreement to any third party without the prior written consent of BWTM. Any attempt to transfer the services without such consent will be considered void and may result in termination of the Service and any Service agreements.
  • Credit Issuance: In exceptional cases where BWTM acknowledges that services were not delivered in accordance with the agreed-upon terms, BWTM may, at its sole discretion, issue credits to the affected user. Credits issued by BWTM under these conditions are not redeemable for cash and can only be used towards future services offered by BWTM.

It is important to note that the issuance of such credits is an exception rather than the norm and occurs only under specific circumstances that warrant such consideration.

  • Digital Products and Services: Digital products and services, including but not limited to downloads, virtual consultations, sessions with mentees, and online plans, are non-refundable once they have been accessed or delivered to the user. Users are encouraged to carefully review their selections and understand the functionalities and requirements of our digital offerings before completing a purchase. Should there be any issues or discrepancies in the delivered digital content or services, users are advised to contact our customer service immediately to address such concerns. However, resolution will not typically involve a refund.
  • Early Termination: Should a user choose to terminate a service prematurely, no refunds will be issued for any undelivered or unused portion of the Service.
  • Service Non-Delivery Due to User Non-Compliance: In instances where our Services cannot be delivered due to a lack of required cooperation from the user, such as failing to provide necessary information or permissions, the user will not be entitled to a refund.


Users are responsible for meeting all requirements critical to successfully delivering the Services. This includes but is not limited to, submitting required documents, completing necessary forms, and granting timely access to any information BWTM needs to provide the Services adequately.

  • Service Modifications: Once payment has been made for a Service, any modifications to the Service before delivery must be mutually agreed upon between BWTM and the user. If modifications are necessary due to unforeseen circumstances or changes in scope, BWTM will work closely with the user to adjust the service accordingly. However, if such modifications are not acceptable to the user, the remedy available will be limited to adjustments to the Service. These adjustments will aim to adhere as closely as possible to the originally agreed terms of the Service.


Refunds will not be issued under circumstances where modifications are made.

BWTM provides security features to protect your services in case of unauthorized access. If security protocols are activated and cannot be bypassed by the unauthorized user, BWTM may refuse any claims regarding non-delivery or dissatisfaction.

Pricing and Price Reductions/Corrections

BWTM reserves the right, at its sole discretion and without prior notice or consent, to change the prices of its Services and to correct inadvertent pricing errors at any time without prior notice.

All prices listed are in U.S. dollars (USD). Users paying with international credit cards should be aware that the final charges on their statements may vary due to fluctuations in exchange rates between the time of pricing and the time of billing. Furthermore, users’ card issuers may impose additional fees or charges for currency conversion. The card issuer determines these charges, which are outside the control of BWTM. Users are encouraged to consult their card issuer for detailed information about any potential foreign transaction fees and currency conversion charges that may apply.

Order Acceptance/Confirmation

BWTM reserves the right to refuse, cancel, or limit any purchase requests for our Services at our discretion. Confirmation of Service orders is subject to review of the agreed-upon terms and conditions and may be adjusted or denied based on these criteria.

BWTM reserves the right to request additional qualifying information from you before processing any order. Upon receiving your order through our official online platform, we will send you an email confirmation. It is important to note that this email confirmation does not signify our acceptance of your order, nor does it constitute a confirmation of our offer to sell the services. The confirmation merely acknowledges that we have received your order.

We reserve the right to accept or decline your order at any time and for any reason.

In the event that BWTM chooses to cancel your order after payment has been processed but before access to the services has been granted, a refund will be issued only if no access to the services has been provided.

Consumers – Personal Use Only

BWTM is committed to providing services specifically designed for end-user customers. We do not support or authorize the resale or redistribution of our services, as our offerings are intended for personal use only.

We reserve the right to refuse or cancel your services at any stage if we suspect that the purchase is intended for resale, unauthorized redistribution, or use by multiple users beyond the scope of the initial service agreement. Such activities do not align with our terms of service.

To ensure compliance with this policy, we may request additional information from you to verify the intended use of the services.

If we determine that the services are being purchased for reasons other than personal use, such as resale or unauthorized sharing, we will take appropriate action, including service cancellation. Any payments made will not be refunded if an order is canceled under such circumstances.

Service Availability and Limitations

Due to the high demand and potential supply constraints associated with some of our services, BWTM reserves the right to limit the availability of certain services at any time. This includes modifying the number of services available for purchase, even after placing an order.

In scenarios where an order has been accepted but we are subsequently unable to fulfill the service due to availability issues, BWTM will promptly notify you of this situation.

If we cannot supply the service you ordered, provided that the service has yet to be delivered and you have not accessed the service, we will cancel the order and issue a full refund of your purchase price. This refund will be processed only using the original payment method used at the time of purchase.

Payment Methods

To use BWTM’s services, you must provide and maintain one or more valid Payment Methods. You authorize BWTM to charge any Payment Method associated with your account if your primary Payment Method is declined or becomes unavailable for payment of your subscription fee. You remain responsible for any uncollected amounts.

If a payment is declined due to expiration, insufficient funds, or other issues and you do not cancel your account, we may suspend your access to the services until we have successfully charged a valid Payment Method. Additionally, please be aware that some Payment Methods may incur fees from the issuer, such as foreign transaction fees or other fees related to processing your payment. BWTM is not responsible for these fees. We advise you to consult with your Payment Method service provider for detailed information about any potential fees.

You are responsible for updating and managing your Payment Methods to ensure continuous service and avoid disruptions due to payment issues.

Updating your Payment Methods

You can update your Payment Methods by visiting your profile page on our website. Additionally, we may periodically update your Payment Methods based on information provided by payment service providers. Following any update, whether initiated by you or automatically by us, you authorize BWTM to continue charging the updated Payment Method(s)

Mentorships

 Mentorships provided by BWTM are offered on a one-time payment basis and are strictly non-refundable. By purchasing a mentorship, you acknowledge and agree that you are not entitled to cancel a session and receive a refund at any time, regardless of the circumstances. This policy applies to all mentorship services offered through BWTM, including but not limited to individual sessions, bundled session packages, and long-term mentorship programs. The non-refundable nature of these payments underscores the commitment of both the mentor and the mentee to the educational process.

Mentor and Mentees

A “mentor” refers to any individual affiliated with BWTM who provides educational guidance, training, or mentorship through scheduled sessions, consultations, or interactions. Mentors are not financial brokers, dealers, or licensed investment advisors and are not authorized to provide financial advice.

A “mentee” refers to any individual who has purchased and is participating in mentorship sessions provided by BWTM. The mentee seeks only educational guidance, training, or mentorship from the mentor and understands that no financial advice will be provided.

Sessions with mentors

For the purposes of this policy, a “session” is defined as any scheduled meeting, consultation, or interaction with a mentor, whether conducted in person, over the phone, via video conferencing platforms such as Zoom, or through any other medium of communication, that is intended to provide educational guidance, mentorship, or training to the mentee. Each session is considered delivered upon the mentor’s preparation for and availability during the scheduled appointment time, regardless of the mentee’s participation.

Booking and Scheduling

Sessions must be scheduled in advance through the designated booking system provided on the BWTM website. It is the mentee’s responsibility to ensure they book sessions at times that are convenient for them. Mentors will make reasonable efforts to accommodate scheduling requests, but there is no guarantee that all requested times will be available.

Cancellation and Rescheduling Policy

You cannot cancel your BWTM Mentorship Sessions. Rescheduling is possible only at the sole discretion of the mentor or BWTM, but rescheduling is not guaranteed.

Once a session has been scheduled, it is considered completed. We do not provide refunds if the session does not meet your expectations or if you choose to leave at any time after the session has started. Attempts to cancel or seek a refund after the session has started or within 48 hours of the session start time will not be honored. No refunds will be issued for missed days or for voluntarily canceling a portion of the mentorship.

 If you need to reschedule a session, you must contact your mentor at least 48 hours before the scheduled session time. Rescheduling requests made less than 48 hours before the session will not be honored, and the session will be considered forfeited. No refunds will be provided for missed or no-show sessions. The determination of whether to offer a replacement session is at the sole discretion of the mentor or BWTM, but this is not guaranteed.

Session Conduct and Requirements

Mentees are required to participate in sessions using their real names and maintain a professional demeanor. Video must be enabled, and backgrounds are not permitted unless they are appropriate and non-offensive. Any disruptive or inappropriate behavior will result in immediate removal from the session and potential cancellation of the mentorship without refund.

Mentees are responsible for ensuring they have the necessary equipment and internet connectivity to participate in sessions. BWTM is not responsible for technical issues on the part of the mentee that prevent participation in a scheduled session. Any session missed due to technical issues on the part of the mentee will be considered forfeited.

Zoom Meetings and Sessions Conducted via Video Conferencing Platforms

Mentors are available to conduct individual 1-on-1 calls using Zoom or other video conferencing platforms approved by BWTM. The frequency and scheduling of these sessions are to be mutually agreed upon by the mentee and mentor, with options for irregular or regularly scheduled meetings (weekly, biweekly, or monthly).

All mentorship sessions will be conducted via video conferencing platforms and may be recorded by the mentors or BWTM. Mentees are required to use their real names and must ensure their video is enabled with no backgrounds unless deemed appropriate and non-offensive. Mentors possess the authority to mute all participants during the sessions and may unmute them for discussions and questions. Screen sharing by the mentor will be used for the dissemination of educational information during the sessions.

It is the responsibility of all mentees to secure access to the required video conferencing platform and maintain their own equipment to ensure smooth participation in the sessions. Mentees are strictly prohibited from disguising their identity or sharing their login information. Only those who have paid for the sessions are allowed to attend.

If mentors or BWTM observe any violations of these rules, they have the right to immediately remove the offending mentee from the session without a refund. Unauthorized access to another person’s account is a serious violation and will not be tolerated, and any misuse of the video conferencing sessions will be thoroughly reviewed by the mentors or BTWN. Inappropriate behavior by a mentee will lead to their immediate removal from the call and cancellation of their mentorship without the possibility of a refund.

All applicable copyright laws will be strictly enforced to protect the intellectual property rights of BWTM, its affiliates, officers, employees, and mentors. Unauthorized recording, reproduction, distribution, or use of any content provided during the mentorship sessions is prohibited and may result in legal action.

Price Changes

BWTM reserves the right, at its sole discretion and without prior notice or consent, to change our Subscription or Mentorship plans and the price of our Services from time to time to reflect changes in market conditions, service costs, or other business-related factors.

If you wish to refrain from accepting the proposed changes to the price of your Subscription or Mentorship plan, you can cancel your plan before the changes become effective. To cancel, follow the cancellation instructions on our website.

No Refunds for Mentorships

 Payments for Mentorships are nonrefundable, and we do not issue refunds or credits for partially used Mentorships. However, if you cancel your Mentorship, you will retain access to the sessions you have purchased that have already been scheduled and are pending.

At any time and for any reason, we reserve the right to offer some of our users a refund, discount, or other forms of consideration (“credits”). Determining the amount and form of such credits and the decision to provide them rests solely and absolutely with us. It is important to note that the provision of credits in one instance does not establish a precedent or entitle you to credits in future similar instances, nor does it obligate us to offer credits in the future under any circumstances.

Unauthorized Modifications to Software or Services

 Making unauthorized modifications to any software or service provided by BWTM violates the software license agreement and other related agreements and policies. Such actions are strictly prohibited.

If a user makes unauthorized modifications, any issues that arise as a result of such modifications, including but not limited to operational failures or security breaches, will not be covered under any existing warranties or support agreements. In such cases, BWTM will not be responsible for repairing defects or restoring service functionality compromised due to unauthorized modifications.

Furthermore, users engaging in unauthorized modifications will face legal consequences. BWTM retains the right to pursue all available legal actions against individuals or entities that breach our agreements by modifying our software or services without authorization. This includes seeking remedies for any damages caused to BWTM or its users due to such unauthorized activities.

Users are strongly advised to adhere to all terms and conditions outlined in their agreements with BWTM, along with BWTM’s along with BWTM’s Privacy Policy, Terms of Use, and Disclaimers. If services need to be customized or modified, users should contact BWTM directly to discuss possible authorized changes that comply with our policies and agreements.

Payments

The payments made by the users constitute the total price for obtaining the rights to access the information provided by BWTM. This payment is not a down payment, deposit, pre-payment, or any other form of conditional or partial payment. It represents a complete and nonrefundable transaction from the user to BWTM.

By making this payment, the user secures the exclusive right to access specific information or services as detailed in the terms of their service agreement. It should be clearly understood that once paid, this amount is nonrefundable under any circumstances, as it grants immediate access to proprietary information.

BWTM emphasizes that this payment is for access rights only and does not confer any ownership of the underlying data or content. Users are encouraged to review their needs and the terms of service carefully before making this payment to ensure it meets their expectations and requirements.

Cancellations

When you cancel your account with us, certain aspects of your account and its associated services are affected as follows:

User Information Retention: In accordance with our Privacy Policy, we will retain certain user information even after account cancellation. This retention is necessary to comply with legal obligations, resolve disputes, and enforce our agreements. For specific details on what information or data is retained and for how long, please refer to our Privacy Policy.

Refunds: Our refund policy clearly states that payments are nonrefundable. This includes any remaining time on your subscription period at the time of cancellation. For more details on our refund practices and exceptions, if any, please refer to our Refund Policy.

To cancel your account, please visit our official website’s “Account Settings” page and follow the instructions provided. Your account will be considered officially canceled once you have completed the steps outlined there and received a confirmation from us. After cancellation, you will no longer have access to the services from the end of your current billing period.

BWTM reserves the right, at its sole discretion and without prior notice or consent, to delete, modify, or update any information or content associated with the website breathingwiththemarkets.com, including but not limited to, changes to BWTM’s Terms of Use, Privacy Policy, Disclaimers, and Refunds and Cancellation Policy.
